Settlement

If settlement is possible Todd will guide you as to how to structure the agreement to provide the greatest benefit. If settlement is not possible he will aggressively defend the lawsuit, raising all available defenses, including those provided by the Fair Debt Collections Practices Act, Fair Credit Reporting Act, and Consumer Collections Practices Act. We also countersue the lender when it is strategically advisable.

Exemptions

Whether your case can be settled or not, Todd will advise you as to the exemptions to which you are entitled under Florida law. Exempt property is property that your creditors can not take from you. Some well-known examples are retirement products such as IRAs, and 401K Plans. Another well-known example is your homestead (residence), although there are several exceptions to the homestead exemption that you will need to discuss with Todd.
